Proença de Carvalho is a brand
with a history in the legal profession.

The firm’s founder, Daniel Proença de Carvalho, began his career in the latter half of the 1960s and soon achieved great notoriety in the legal world and in Portuguese society.

His career established him as one of the most prominent lawyers of his generation. First as a solo practitioner, then as head of Proença de Carvalho & Associados. In 2010, he joined the Iberian firm Uría Menéndez under the Portuguese name "Uría Menéndez - Proença de Carvalho", an association that came to an end in 2024.

We aim to build upon and strengthen the legacy of Proença de Carvalho, while remaining steadfast in our commitment to the brand’s values: trust, courage, vision, precision, proximity.

Code of Conduct

Strict rules of conduct to guarantee legal profession ethic principles

Proença de Carvalho commits to providing legal services in strict compliance with ethical and professional principles. Our Code of Conduct highlights the importance of complying with legal regulations, confidentiality, and prevention of money laundering and corruption.

Rules of Conduct

Permanent compliance with professional rules

Proença de Carvalho’s team members must adhere to the Portuguese Bar Association by-laws and other applicable legal and professional regulations, including, without limitation, provisions regarding incompatibilities and impediments applicable to the exercise of their activity.

Confidentiality and legal professional privilege

Proença de Carvalho members must keep any information they have access to under strict confidentiality, regardless it is obtained directly from clients or otherwise as a result of their work.

Proença de Carvalho members must therefore respect the confidentiality and legal professional privilege of all information regarding Proença de Carvalho and our clients, even after their duties and/or relationship with Proença de Carvalho have ended.

Strict Prevention of Money Laundering and Terrorism

Proença de Carvalho members must comply with national and supranational laws on (i) preventing and combating money laundering and terrorist financing, (ii) (national or cross-border) mechanisms with tax relevance, namely those provided for in Law no. 26/2020, and (iii) market abuse practices, namely insider dealing, unlawful disclosure of inside information and market manipulation under the terms of Regulation (EU) no. 596/2014, and must therefore comply with all procedures for this purpose in force at Proença de Carvalho at any given time.

Anti-corruption policy

Proença de Carvalho members are prohibited, by themselves or through an intermediary, from engaging in any practices, including, without limitation, practices of corruption and/or trading in influence, with a view to having a third party alter their professional conduct in the interests or for the benefit of a particular individual.

Conflicts of interest

Proença de Carvalho members must avoid any situation or activity that could lead to conflicts of interest, and may not accept or continue any matter where a conflict of interest arises.

To this end, Proença de Carvalho members must comply at all times with all procedures regarding the prevention and control of conflicts of interest in force at Proença de Carvalho.

Data protection

Proença de Carvalho members must process the personal data of clients, suppliers, partners and other individuals of the law firm in strict compliance with applicable laws, and must comply at all times with all procedures in force at Proença de Carvalho.

Disclosure of information regarding Proença de Carvalho

The disclosure of information regarding Proença de Carvalho may only be carried, out under the terms of their respective functions, by the respective managing partners and/or by a Proença de Carvalho member duly authorised for this purpose.

Relationship with third parties

Proença de Carvalho members must treat third parties with whom they deal in a cordial and loyal manner, with respect and independence.

Media relations and social networks

Proença de Carvalho members shall comply with the fundamental values of legal professional privilege, impartiality and decorum in the practice of law, in accordance with the Portuguese Bar Association By-laws on legal professional privilege and under the terms set out therein.

With regard to the use of social networks, blogs and other media, Proença de Carvalho members will act in accordance with the information security policy and the use and protection of professional e-mail regulation, and other communication media in force at any given time.

Relations with colleagues

Proença de Carvalho members are prohibited from engaging in any harassing or discriminatory behaviour.

The implementation and compliance control of this Code of Conduct are ensured by Proença de Carvalho’s management of and/or by those authorised to that effect. Any member of Proença de Carvalho has the right and duty to contact Proença de Carvalho’s management so as to clarify any doubt they may have with regard to the principles and rules of this Code of Conduct, as well as to report any breach or violation hereof. The Code of Conduct is defined and approved by Proença de Carvalho’s management and becomes effective on the date of its approval, after which it shall be communicated and disclosed to all Proença de Carvalho members.
